Limited Warranty

Life Mobility Solutions, LLC, SmartScoot™ (LMS) warrants your SmartScoot™ against defects in materials and workmanship from the date of the original retail purchase as follows:

2-Year Limited Warranty:  Structural Frame under normal use conditions.

1-Year Limited Warranty:  All components, including motor, brakes, electrical, and axles under normal use conditions.

1-Year Limited Warranty:  Battery under normal use conditions.

This limited warranty extends only to the original owner and is not transferable to anyone else.

If a defect exists, LMS will, at its option and to the extent permitted by law either (1) provide components to repair the SmartScoot™ using new or refurbished parts at no charge to you; (2) exchange the SmartScoot™ with functionally equivalent product that is new or refurbished; or (3) refund the original purchase price.  After repair or replacement, the SmartScoot™/functionally equivalent product will be covered by this limited warranty for the length of the remainder of the original limited warranty period, or 90 days after LMS ships the SmartScoot™/functionally equivalent product to you.  LMS’s responsibility to repair or replace the SmartScoot™, or to refund the purchase price, is your exclusive remedy.  This warranty excludes damage caused by abuse, misuse, accidents, unauthorized repairs, alterations, modifications, failure to follow instructions in the User’s Instruction Manual and battery Operating Instruction, or other causes that are not defects in materials and workmanship for which LMS is responsible.

This Limited Warranty does not cover parts which may, under normal wear and tear, require replacement including, without limitation, tires, upholstery, fuses, etc.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, LMS IS NOT LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR SERVICE OF THE SMARTSCOOT™.  THE WARRANTY AND REMEDIES STATED ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES, OR CONDITIONS, WHETHER ORAL, WRITTEN, EXPRESS, STATUTORY, OR IMPLIED TO THE EXTENT PERMITTED BY APPLICABLE LAW.  LMS SPECIFICALLY DISCLAIMS ALL IMPLIED AND STATUTORY WARRANTIES INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  IF IMPLIED WARRANTIES CANNOT BE DISCLAIMED, SUCH WARRANTIES ARE LIMITED IN DURATION TO THE DURATION OF THIS WARRANTY.  Any recovery is limited to the original purchase price.  No person is authorized to modify this Limited Warranty.

THIS WARRANTY DOES NOT AFFECT YOUR STATUTORY RIGHTS.

Some states do not allow limitations on how long an LMS lied warranty lasts, or exclusions of incidental or consequential damages and the above limitations may not apply to you.  This Limited Warranty gives you specific legal rights. You may have other rights, which vary from state to state.

This warranty and all lawsuits, disputes, and claims will be governed by and interpreted under the laws of the State of New Mexico, regardless of any conflict of law principles.   The parties also irrevocably consent to the jurisdiction of the State Court of Santa Fe County, New Mexico, and agree that the State Court of Santa Fe County, Georgia shall have exclusive jurisdiction and be the sole venue for the consideration of any lawsuits, disputes, and claims between the parties.

The parties hereby waive the right to any jury trial on any lawsuit, dispute, claim, or controversy.  The parties also waive any right to consolidate or to have handled as a class action any proceeding on any lawsuit, dispute, claim, or controversy.  The parties agree that any proceedings will be conducted solely on an individual basis.  The parties agree not to seek to have any lawsuit, dispute, claim, or controversy heard as a class action, private attorney general action, or in any other proceeding in which either party acts or proposes to act in a representative capacity.

If any provision herein is found to be illegal or unenforceable, that provision will be severed with the remaining in full force and effect.

If you disagree with any of the terms and conditions herein, you must submit a written request to pam@smartscoot.com for a Return Authorization within 3 days of delivery.  Do not unpack or assemble the SmartScoot^™.  The scooter must be returned in its original box and in new and unused condition, accompanied by the original receipt. All other returns must be made within 14 days of delivery and only in “as new” condition. The customer is responsible for all shipping costs including incidental shipping damage caused by improper packing. A Return Authorization must be made by written request to pat@smartscoot.com and the return must be accompanied by the original receipt. The scooter must be returned in its original box. All returns are subject to a 10% restocking fee.

I understand and recognize that the equipment is unfamiliar to me, and it is my sole responsibility to use utmost care and caution when determining where and when I ride the scooter utilizing the guidelines in the SmartScoot™ Users Instruction Manual.

I agree to be the sole person driving the scooter and I am fully responsible for any person or persons who, with or without my consent, sit on, or ride the scooter. I hereby release, waive, and discharge the right to seek medical reimbursement or the legal prosecution of Life Mobility Solutions, LLC for any physical injury resulting to myself or someone else or property damage from the equipment provided by Life Mobility Solutions, LLC.

I hereby agree to defend, indemnify and hold harmless Life Mobility Solutions, LLC, its managers, members, employees, and agents for any loss or damages awarded by a court of competent jurisdiction resulting from any claim, action, or demand including reasonable attorney’s fees arising out of or related to the SmartScoot ™ and equipment provided by Life Mobility Solutions, LLC.   It is my express intent that this Waiver of Liability, Disclaimer, and Indemnification shall bind my family, my heirs, assigns, and personal representatives.  I am aware that the operation of a personal mobility device such as the SmartScoot™ has inherent risks.  By reading, understanding, and signing Life Mobility Solutions, LLC Waiver of Liability, Disclaimer, and Indemnification I fully accept and assume responsibility for all such risks, losses, costs, and damages incurred as a result of operating the SmartScoot™.

How will I know my order is confirmed?

Cancellations of Custom Orders

In the event, you have made a custom or made to order products cannot be canceled or refunded as these products are put into production specifically for your order. 

These units, are custom made to your specification or created once you order. Once you place your order they start building your unit. Your warranty will guarantee you a fully functional and operational product. If it is not clear whether your order is custom or made to order, please message or call us. 

All sales are final for Custom made and Made-to-order products.

Refunds and Returns

If you need to exchange your product, you may do so. You, as the customer, are responsible for any shipping costs throughout any returns and exchange processes. 

Not all orders are available for return once they have shipped. We order our products directly from the manufacturer. Therefore, if the manufacturer will not permit us to return a product, we cannot offer you a return. This often varies on a case-by-case basis; please reach out to us if you would like specific information on your brand and/or product. 

Due to drastically increasing LTL/freight shipping costs, any outright returns will incur 25% cancellation fee + return shipping costs. If you are replacing the product with something else, we may be able to help you cover some of the costs depending on the product. 

Shipping Times

We promise to do our best to get your order to you as soon as possible.  We provide estimated shipping times on the product pages based upon what our suppliers and freight companies tell us, and those estimated shipping times may change or vary without notice (Due to supply chain issues, the steel mills behind on making metal, the manufacturers delayed because of the mills, the overwhelmingly demand on shipping, factory/warehouse and dock workers and so on). 

Order delays have proven to be unavoidable and outside of Home Power Direct's control. While this might be frustrating, we ask you to please be patient and understanding with us in these tough times. We thank you for your business and appreciate your patience.

Warranty 

Warranties vary depending upon the manufacturer - see individual product pages for details. Warranty damages occur over time and from use. If an item was damaged upon arrival, and not reported within 30 days, that is not a warranty claim.

Can I ride my SmartScoot™ outside?

Yes, the SmartScoot™ is designed to ride inside and outside on paved surfaces in accordance with the SmartScoot™ Users Instruction Manual and its Safety Instructions.

Can I take my SmartScoot™ travel mobility scooter on an airplane?

Any battery that contains less than 25 grams of equivalent lithium content (ELC) and is under 300 watts is currently allowed for airline travel. The SmartScoot™ battery has an ELC of 24 grams and is 288 watts. It is advisable to check with your airline before you travel. Here’s more information from popular airlines:

Do I need a license for my SmartScoot™?

No license is required to operate a scooter in the United States. Always check and obey all local laws regarding electric mobility scooters.

How does the SmartScoot™ perform on grass, snow, or mud?

Do not use the SmartScoot™ in such conditions.

How does the SmartScoot™ perform on inclines?

SmartScoot™ will handle all handicap ramps and inclines of 6˚ or less. It is recommended that the rider leans forward when riding up inclines.

How far can I go on one full charge of the battery?

On average you can travel approximately 12 miles on a single charge, however, this will vary based on the type of terrain you’re on, your weight, the temperature, and other conditions. It is recommended that you recharge your battery once the battery indicator reaches 2 bars and no sooner, to preserve its longevity.

How long does it take to charge my battery?

It takes approximately 1-2  hours for a complete charge. The initial charge may take longer (up to 5 hours).

How long will my battery last?

The battery will last up to 500 recharges.   It will need to be charged when the battery level falls to or below 50% as indicated on the control panel (1-2 solid red dots). Depending on usage this might occur as much as once a week (or more) however keep in mind that unnecessary recharging will reduce the life of the battery.

Is the SmartScoot™ covered by insurance?

At this time, most major health insurance companies’ coverage does not extend to the purchase of the SmartScoot™. In general, if you cannot walk at all, insurance companies will pay for an electric wheelchair but not for a mobility scooter.

Is there any maintenance required with the SmartScoot™ travel mobility scooter?

The only user maintenance is to charge the battery and keep the machine clean with a damp, soft cloth. In addition, the steering locking system and front wheel assembly may loosen with use. Check frequently and tighten.

What if I have problems with my SmartScoot™?

The SmartScoot™ is covered by a comprehensive warranty, 2 years on the frame and 1 year on all of the components.

What is the maximum weight of a rider that the SmartScoot™ can handle?

Up to 250 lbs.

Where can one ride the SmartScoot™ travel mobility scooter?

All travel mobility scooters with more than two wheels are permitted wherever walking is the only alternative. This includes public buildings such as airports, museums, trade shows, shopping malls, and department stores as well as outdoor facilities like theme parks, county fairs, walkways, etc.

Does the SmartScoot™ have a height restriction?

The SmartScoot™ travel mobility scooter is able to accommodate a wide range of heights due to the adjustability of the seat and handlebar. So, if you are 4’11” or 6’6″, the SmartScoot™ could work for you.

Where is the SmartScoot™ travel mobility scooter made?

The SmartScoot™ travel mobility scooter and its accessories are manufactured in China.

Do I have to be home to receive delivery of my SmartScoot™?

Your SmartScoot™ travel mobility scooter will require a signature upon receipt due to the value of the shipment. Tracking information will be emailed to you on the day the SmartScoot™ ships so you will know which day it will arrive.

Can the controls be moved to the left-hand side of the handlebar?

Yes! Please contact customer service at (855) 726-6866 x 1 for details. The brake and the control panel will look basically the same. The throttle will appear upside down.
